A recently filed lawsuit claims that four of the largest workers’ compensation insurers in California hacked into plaintiff electronic files maintained by their workers’ compensation attorneys.  They claim these four companies hacked into the various systems of a number of years and were specifically looking for attorney client privileged documents.

money-problemsThe reason the lawsuit claims these large workers’ compensation insurance companies hacked into these files was because they wanted to use the allegedly stolen documents to give them a major advantage during litigation of workers’ compensation claims.  In other words, these four workers’ compensation insurance carriers could deny claims, and then whey they go to trial to defend the claim’s denials, they would have access to what injured workers discussed wither their attorneys and use this information to their advantage in court, according to allegations contained in a recent news feature from Business Insurance obtained from the complaint filing as part of this matter. According to a recent news report from News 4 Jax, a 69-year-old construction worker was killed while working at a construction site.  In this case, he was working on a massive pavement project when a street sweeper came by and hit him.  He was run completely over by the street sweeper and crushed by its massive wheels and brushes.streetvacuum

As soon as he was hit by the street sweeper, his fellow construction workers dialed 911. When first responders arrive at the scene of what would eventually prove to be a fatal on-the-job accident, the man was in very bad shape.  First, they had to work to get him out from under the massive street sweeper with the help of the fire department.  They could not risk simply driving the huge commercial vehicle off the man because that would likely result in significantly more damage.

Once they got the street sweeper of the victim, they attempted to provide immediate medical attention.  EMTs realized that he was in far too serious condition for an ambulance ride to a local hospital, so they called in a medevac helicopter, so the victim could be airlifted to a larger level-one trauma center. There are a lot of dangerous workplaces and types of occupations in Massachusetts.  Some of the jobs for which one might expect high injury rates are construction work in downtown Boston or commercial fishing in Gloucester.  While it is certainly more likely to get hurt in one of these traditionally dangerous occupations, a worker can be injured in any job, and the appropriate remedy is generally to file a claim for workers’ compensation.

Working on a construction site is among the most dangerous jobs in the United States.  Each year, construction workers are killed when they are hit by cars on roadside construction projects. We also see workers hit by falling objects, fall off high buildings under construction, and get run over by heavy equipment such as cranes and fork lifts. While it would seem unlikely for a person to get killed by a forklift, as they are required to follow various safety guidelines at construction sites, we are actually hearing about accidents such as these all the time in news articles from around the nation.bulldozer

According to a recent news feature from WCVB News 5 Boston, a worker in Phillipston, Massachusetts was killed when a bulldozer operator backed over him while at a job site.  Authorities say the job involved construction of a park owned by the town.  While the 60-year-old was working at the job site, his was hit and crushed by the large bulldozer while it was in reverse.  First responders were called to scene, but here nothing they could do for him.  In many cases, they will attempt to stabilize a patient for transport to a local level one trauma center, but in this case, they worker was crushed and there was nothing left to do but pronounce him dead on the scene and wait for a medical examiner to arrive. Many people will remember the story of the woman who was attacked by her employer’s pet chimpanzee.  She was viciously attacked by the animal while working in the home, and her entire was face was essentially destroyed.  While this normally would have required a lifetime of wearing protective dressings and pain and suffering, she was the recipient of a full face transplant, which was an experimental procedure at that time.hideface

Since having the procedure after her horrific on-the-job accident, she was required to take drugs know as an anti-rejection agent.  Whenever someone has a transplant, there is a decent chance that the body will think the donor tissue is a foreign object, which essentially it is, and will fight the donor tissue causing the organ transplant to be rejected.  In the case of a face transplant, there is a lot of medication that is required, and that medication has a lot of side effects. According to recent news from the Taunton Gazette, a group of workers and family members gathered at the steps of the Massachusetts statehouse in downtown Boston to fight for workplace safety measures for construction sites.  They were also there to mourn the more than 60 construction workers who died in fatal workplace accidents last year.

workerexcavatorThose in attendance erected a temporary memorial wall and covered the wall with flowers and read the names of the victims aloud as a bagpiper played at the memorial ceremony.  Among those there to support the workers and move for change in terms of worker safety was the father of a construction worker who died on the job in Taunton. It is common to see someone wearing a brace on his or her hand or wrist and immediately assume that person suffers from carpal tunnel syndrome (CTS).  While everyone has heard of carpal tunnel syndrome, many people do not understand what exactly the condition is and that it is often a work-related injury that may make an employee eligible to receive workers’ compensation benefits.

There is no question that construction work is dangerous, as there are many cases of serious or even fatal on-the-job injuries each year.  Most of these construction site injuries involve someone getting hurt from falling from a high structure, being hit by a hard object, or being injured by a large piece of moving machinery.  However, these are not the only ways to suffer a workplace injury on the construction site.
